These Terms of Use (“Terms”) are an agreement between you and devmobileuae (“we”, “us”) governing your use of the Grit iOS application and this website (together, the “Service”). By downloading or using Grit, you agree to these Terms. If you do not agree, do not use the Service.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Grit on Apple devices that you own or control, as permitted by the App Store terms. These Terms act as the end user license agreement (EULA) for the app.
2. Subscriptions and purchases
Grit is free to download. Grit Premium unlocks the full daily protocol, every lane, Hard Mode, and the complete ledger, and is offered as an annual subscription, a weekly subscription with a 3-day free trial, or a one-time lifetime purchase.
- Billing. Payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Free trial. The trial converts to a paid subscription unless cancelled before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Managing and cancelling. Manage or cancel in your App Store account settings: apps.apple.com/account/subscriptions. Deleting the app does not cancel a subscription.
- Lifetime. The lifetime option is a one-time purchase that unlocks Premium for as long as Grit is offered.
- Refunds. Purchases are processed by Apple, and refunds are handled by Apple under App Store rules.
- Price changes. If prices change, you will be notified per App Store rules and can cancel before the change takes effect.
3. Not medical or professional advice
Grit is a habit and discipline tool. It does not provide medical, psychological, fitness, or other professional advice, and it is not a substitute for professional help. Tasks and challenges are suggestions; use your own judgment, consult a physician before starting an exercise routine, and stop any activity that causes pain or distress. Step data shown in Grit comes from Apple Health and may be incomplete or inaccurate.
4. Acceptable use
- Use the Service only for lawful purposes.
- Do not reverse engineer, decompile, or modify the app except where the law expressly permits it.
- Do not interfere with the Service, including its challenge cohort infrastructure, or attempt to access it in unintended ways.
5. Your content
Journal entries and other content you create in Grit remain yours. They are stored on your device, and we claim no rights over them.
6. Analytics and technical data
You agree that we may collect and use technical data and usage information about your device and the app, for example device model, OS version, app version, feature usage, and diagnostic events, including through analytics providers such as PostHog, to operate, maintain, and improve the Service. This data is collected and handled as described in the Privacy Policy.
7. Our intellectual property
The app, this website, and their artwork, characters, names, design, and code are owned by us or our licensors and are protected by intellectual property laws. Except for the license above, no rights are granted to you.
8. Changes to the Service
We may add, change, or remove features, including challenges and cohorts, at any time. We may discontinue the Service with reasonable notice where practicable.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
11. Apple-specific terms
These Terms are between you and us, not Apple. The following applies because Grit is distributed through the App Store:
- Apple has no obligation to provide maintenance or support for the app; we are solely responsible for it and for addressing any claims relating to the app (including product liability, legal or regulatory compliance, and consumer protection claims).
- In the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Termination
You can stop using Grit at any time by deleting the app. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination do survive.
13. Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law rules, except where the mandatory consumer protection law of your country of residence applies.
14. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page, with the date above. Continuing to use the Service after changes take effect means you accept the updated Terms.
